Further to your enquiry regarding contaminated land and associated issues at the above site, I am writing on behalf of this Department
 to advise you of the results of a search of our records and to inform you of the council&#8217;s position with regard to Part IIA.<o:p></o:p>
<o:p>&nbsp;</o:p>
Arun District Council is in the process of implementing its contaminated land strategy to identify land within the district that is potentially
 contaminated. At the current time, this Department is identified and prioritising sites within the area that have been or are currently occupied by a potentially contaminative use. Initial investigations in the form of desktop studies and/or site inspections
 are in the process of being undertaken, with the intention of re-prioritising sites for more detailed inspection at a later date. At present, Arun District Council has no entries into its Register of Contaminated Land and is not considering taking formal or
 informal action under Part IIA of the Environmental Protection Act 1990.<o:p></o:p>
<o:p>&nbsp;</o:p>
Following a search of this Department records, a number of land uses known to be potentially contaminative within an approximate 150 metre
 radius of the site have been identified. The subject site is indicated by a small orange location circle on the attached map and the areas of potential contamination are highlighted in yellow. These areas are discussed below:<o:p></o:p>
<o:p>&nbsp;</o:p>
Sea Lane Sewage Treatment Works (STW)<o:p></o:p>
The larger, almost rectangular area that is bisected by the search boundary is the Sea Lane Sewage Treatment Works (STW). This pumping station is in use and is managed
 by Southern Water. Leaks or emissions from sewage and/or methane and from the fuel that powers the pump are the main risks associated with this plant. The site is only accessed by maintenance staff, therefore the risk to human receptors is considered low.
 It is recommended that further information, if required, is obtained from the Environment Agency who can be contacted

If land within 10 metres of this area was promoted for redevelopment or, if subsequent to this e-mail potential contamination on or in the vicinity of the site is suspected, it
 is likely that a condition would be added to any planning consent, requiring &#8211; as a minimum &#8211; a risk assessment to be completed by a suitably qualified, independent consultant. This risk assessment would dictate whether further work, for example, intrusive
 investigation, is required.<o:p></o:p>
<o:p>&nbsp;</o:p>
Mewsbrook Landfill (closed)<o:p></o:p>
The small, circular area overlying the access road to Rustington Convalescent Home is the former Mewsbrook Landfill. The landfill was licenced by the Environment
 Agency (ref.: WD 13/5/3 &#8211; ADC) and it is understood that approximately 5000 cubic meres of inert waste was tipped in 1977. Several planning records from the late 1960&#8217;s and through the 1970&#8217;s (refs.: LU/271/69, LU/168/77, LU/239/79B and LU/354/79) do not make
 reference to the landfill. If land within 200 metres of this area was promoted for redevelopment or, if subsequent to this e-mail potential contamination on or in the vicinity of the site is suspected, it is likely that a condition would be added to any planning
