For your reference the public rights of way on the attached plan are footpaths which include FP69, 568 and 603, which are represented by yellow dashed lines, in relation to the property in question. The line does not denote the definitive width of the public right of way. <o:p></o:p></p> <p class="MsoNormal"><span style="color:black">A public footpath is a highway over which the public have a right of passage on foot only. Walkers may take a pram, pushchair or wheelchair over the route if practicable. The route is subject to the provisions of Section 34(1) of the Road Traffic Act 1988. Section 34(1) of the Act reflects the statutory provisions which were first contained in Section 14 of the Road Traffic Act 1930 which came into force on 1 December 1930. This provision makes it an offence to drive a motor vehicle <u>without</u> authority on any road being a footpath or bridleway. There may be however private vehicular rights, limited to particular individuals or associated with a particular property. A public footpath may have a surface of grass, dirt, stone or ‘bitmac’ (bituminous macadam). However a local authority is only obliged to maintain it to a standard sufficient for safe walking.</span><o:p></o:p></p> <p class="MsoNormal">3. On the information available to me, the following road and traffic schemes are in the general vicinity to the property in question:<o:p></o:p></p> <p class="MsoNormal">On 25 April 2019 Guildford Borough Council adopted their Local Plan Strategy and Sites 2015-2034. Land has been identified under Policy A42 for potential new slip roads onto the A3 at Burntcommon. This would involve the provision of a new northbound on-slip to the A3 Trunk road from A247 Clandon Road and a new southbound off-slip from the A3 trunk road to A247 Clandon Road. The cost of each slip road is estimated at approximately £10 million and would likely be delivered by Highways England and/or a developer. It is anticipated that this would be delivered between 2021 and 2027, but may be dependent on a nearby site identified for residential development. This agreement relates to highway improvement works along Burnt Common Lane, Ripley, in the vicinity of a new development known as Oldlands Drive. These works will involve the provision of 2 bell-mouth junctions and a pedestrian path on the east side of Burnt Common Lane. This relates to a development submitted to Guildford Borough Council under planning permission 19/P/02191. A cash deposit of £27,021.01 supports this agreement. <o:p></o:p></p> <p class="MsoNormal">4. Please refer to the answer and plan given at enquiry one.<o:p></o:p></p> <p class="MsoNormal">5.
